Enrch, Inc. Terms of Service

These Terms of Service govern your use of Tele Opinion, our website located at https://www.tele-opinion.com, and any related services provided by Enrch, Inc. ("we," "us," or "our").

When you create a Tele Opinion account or use Tele Opinion, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from further using the app, accessing our website, or using any other services provided by Enrch, Inc.

If you access or download Tele Opinion from (1) the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service; and/or (2) the Google Play Store, you agree to the Android, Google Inc. Terms and Conditions including the Google Apps Terms of Service.

We, Enrch, Inc., reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page and notify you through the app and/or the email address you provided when you created your account. Any changes to these Terms of Service will take effect immediately from the date of publication.

These Terms of Service were last updated on June 22, 2024.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

Limitations of Use

By using Tele Opinion and our website, you warrant on behalf of yourself, any entity who you represent who has entered into these Terms of Service, and your users that you will not:

• Modify, copy, prepare derivative works of, decompile, or reverse engineer Tele Opinion or any materials and software contained within Tele Opinion or on our website;

• Remove any copyright or other proprietary notations from Tele Opinion or any materials and software contained within Tele Opinion or on our website;

• Transfer Tele Opinion or any of its associated materials to another person or "mirror" the materials on any other server;

• Knowingly or negligently use Tele Opinion or any of its associated services in a way that abuses or disrupts our networks or any other service Enrch, Inc. provides;

• Use Tele Opinion or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;

• Use Tele Opinion or its associated services in violation of any applicable laws or regulations;

• Use Tele Opinion to send unauthorized advertising or spam;

• Harvest, collect, or gather user data without the user’s consent; or

• Use Tele Opinion or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Intellectual Property

The intellectual property in the materials in Tele Opinion and on our website are owned by or licensed to Enrch, Inc. You may download Tele Opinion to view, use, and display the application on your mobile device for your personal use only.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or these Terms of Service and may be terminated by Enrch, Inc. at any time.

User-Generated Content

You retain your intellectual property ownership rights over content you submit to us for publication within Tele Opinion and/or on its corresponding website. We will never claim ownership of your content but we do require a license from you in order to use it.

When you use Tele Opinion or its associated services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

The license you grant us can be terminated at any time by deleting your content or account. However, to the extent that we (or our partners) have used your content in connection with commercial or sponsored content, the license will continue until the relevant commercial or post has been discontinued by us.

You give us permission to use your username and other identifying information associated with your account in a manner that is consistent with your privacy preferences and our Privacy Policy.

Automatic Updates

You give us permission to download and install updates to Tele Opinion on your device in accordance with your privacy preferences. This permission can be revoked at any time by deleting Tele Opinion from your device.

General Disclaimer

The information provided by Tele Opinion ("we," "us," or "our") on https://www.tele-opinion.com (the "Site") and through our Tele Opinion mobile app (the "App") is for general informational purposes only and does not constitute professional advice. All information on the Site and the App is provided in good faith; however, we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Site or App. Your use of the Site, the App, and your reliance on any information on the Site or App is solely at your own risk.

The advice and information provided by health, legal, tax, and educational professionals are based on their professional judgment and expertise. We are not responsible for the accuracy, reliability, or quality of the advice provided. UNDER NO CIRCUMSTANCE SHALL WE HAVE ANY LIABILITY TO YOU FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SITE, THE APP, OR RELIANCE ON ANY INFORMATION PROVIDED ON THE SITE OR APP. We are not responsible or liable for any actions, claims, losses, damages, liabilities, or expenses arising out of or related to your use of the App or the advice provided by health, legal, tax, and educational professionals. By using the App, you agree that any reliance on the information or advice provided is at your own risk.

Third-Party Disclaimer

The App facilitates connections between customers and independent health, legal, tax, and educational professionals. We do not control, monitor, or have any responsibility for the conduct of the professionals or the content they provide. Any interactions or engagements between customers and professionals are solely between them.

No Warranties

We make no representations or warranties about the suitability, reliability, availability, timeliness, or accuracy of the information, services, or advice provided by the professionals through this App. Users should verify all information independently.

Conduct Policy

All users and professionals must adhere to a code of conduct that promotes professionalism, respect, and ethical behavior. We do not tolerate any form of discrimination, hate speech, harassment, or disrespectful behavior. This includes but is not limited to:

• Discrimination or harassment based on race, ethnicity, creed, color, national origin, age, religion, sex, sexual orientation, gender identity, disability, or any other protected characteristic.

• Hate speech, which includes any content that demeans, defames, or promotes discrimination or violence against individuals or groups based on the aforementioned characteristics.

• Any form of harassment or conduct that creates a hostile environment, including threats, intimidation, or any other behavior that undermines the dignity and respect of others.

Violations of this conduct policy may result in termination of access to the App.

Consent

By using the Site and the App, you consent to the terms of this disclaimer and agree to release us from any and all liabilities, claims, or causes of action arising from your use of the Site, the App, or the advice provided by professionals. Your use of the Site and the App signifies your understanding and agreement to these terms.

Right to Delete Your Profile

You have the right to delete your Tele Opinion profile at any time. Deleting your profile will remove your account information and any content you have uploaded to our servers. To delete your profile, please follow the instructions at DeleteProfile page. Please note that some information may remain in our records even after deletion to comply with legal obligations, resolve disputes, and enforce our agreements.

Accuracy of Materials

The materials appearing in Tele Opinion or on our website are not comprehensive and are for general information purposes only. To the extent permitted by law, Enrch, Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials in Tele Opinion or on our website, or otherwise relating to such materials or on any resources linked to Tele Opinion and our website.

Enrch, Inc. has not reviewed all of the sites linked to Tele Opinion or on its corresponding website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by Enrch, Inc. of the site. Use of any such linked website is at your own risk and we strongly advise you to make your own investigations with respect to the suitability of those sites.

Notice Regarding Apple

To the extent that you are using or accessing Tele Opinion on an iOS device, you acknowledge and agree to the terms of this clause. You acknowledge that these Terms of Service are between you and Enrch, Inc. only, not with Apple Inc. (Apple), and Apple is not responsible for Tele Opinion and any materials available in Tele Opinion.

Apple has no obligation to furnish you with any maintenance and support services with respect to Tele Opinion.

If Tele Opinion fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the mobile application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Tele Opinion and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our responsibility.

Apple is not responsible for addressing any claims by you or any third party relating to Tele Opinion or your use of Tele Opinion, including but not limited to (1) product liability claims; (2) any claim that our mobile application fails to conform to any applicable legal or regulatory requirement; and (3) claims arising under consumer protection or similar legislation.

Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that our mobile application infringes that third party’s intellectual property rights.

You agree to comply with any applicable third-party terms when using Tele Opinion, including any Usage Rules set forth in the Apple App Store Agreement of Service.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms of Service and, upon your acceptance of these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary of these Terms of Service.

You hereby represent and warrant that (1) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.

Right to Terminate

We may suspend or terminate your Tele Opinion account and right to use Tele Opinion and these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Cancellation, Refund, and Payout Policy

Cancellation Policy for Customers

Cancel your appointment through our app. Cancel at least 4 hours in advance to avoid a cancellation fee. If canceled within 4 hours, the booking fee will be retained as the cancellation fee, but the original appointment fee will be refunded. Refunds take up to 2 business days to process.

Rescheduling Policy for Customers

Reschedule your appointment through our app anytime, free of charge. Rescheduling is subject to the availability of alternative time slots with the same expert.

No-Show Policy for Customers

If you miss your online appointment without canceling, it will be considered full attendance, and no refund will be issued.

Cancellation & No-Show Policy for Experts

If an expert cancels or doesn't show up for an appointment, we will refund the appointment fee and booking fee to the customer. Additionally, the booking fee will be deducted from the expert's next payout.

Pricing and Payout Policy for Experts

Tele-Opinion is in its early stages, and we are actively working to find the best way to reduce commissions and maximize payouts to experts.

Currently, experts in India receive INR 1,200 per completed paid appointment after Tele-Opinion’s service and processing fees. However, this amount may change based on factors such as Apple/Google platform fees, currency conversion rates, taxes, and other operating costs.

Payouts are made every other Friday via bank transfer to the expert’s registered UPI. Both the payout amount and payout schedule are subject to change as we evolve.
